Yep, THE GOLD RUSH has indeed been PD since 1952, but the Chaplin Estate has the financial clout to harass people into silence. This wouldn't happen if Paul Killiam or even ---(have to spit if I say the name) Raymond Rohauer were still here.
The fact has Chaplin was still a British citizen has nothing to do with it, the film was a United Artists release and Chaplin's own production company was an American incorporated entity, so yes, American copyright laws apply, and Chaplin only renewed the 1942 version, which in my opinion, he can keep, who wants to run that.
Come to think of it, ALL of Chaplin's 1920's films are now public domain in America, and CITY LIGHTS will go PD very soon.
